Federal Judge Mandates Freedom of Abrego Garcia from Immigration Custody
A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks legal authority.
"Since his release after erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.
The situation stems from a erroneous deportation to El Salvador in March, which US authorities later admitted was an error. After his return to the United States to answer alien smuggling allegations, he was held in federal detention.
In her decision, the court pointed out that the authorities lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
Context of the Case
The court proceedings center on conflicting assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.
He has also pleaded not guilty to the smuggling counts, which are part of a separate trial in Tennessee.

The judge, who was hearing his petition to removal in a federal court, ruled that he must now comply with the conditions of his bond from custody in Tennessee. This order effectively transfers his supervision to the Tennessee court.
