International Committee of the Red Cross Assists Hamas in Search for Bodies of Captives in Gaza Strip

The International Committee of the Red Cross (ICRC) confirmed that its representatives joined members of Hamas into areas of the Gaza Strip currently controlled by Israeli military control to support the search for the remains of Israeli hostages.

Truce Agreements and Hostage Bodies Handover

Under the US-brokered ceasefire, which took effect on 10 October, Hamas is obligated to hand over the bodies of all Israeli hostages promptly. In exchange, Israel has consented to transfer the remains of 15 Palestinians for every Israeli body returned.

Hamas has so far handed back the remains of 15 of those held captive but zero in the last five days, as some of those bodies are thought to be in areas past the ceasefire boundary marking the temporary truce line.

Red Cross Role as Impartial Facilitator

“At the request of the parties, the International Committee of the Red Cross (ICRC) accompanied a participant in the hostilities as the party searched for the bodies of the deceased past the IDF-designated ‘yellow line’,” stated a spokesperson for the committee.

She continued: “Those involved to the hostilities determined the procedures of the operation and entrusted the ICRC to serve as a impartial mediator. We was not involved in those negotiations.”

The official further clarified: “The ICRC was not involved in the physical hunt for the deceased nor does it take part in the physical recovery of human remains.”

Global Humanitarian Law and Duties

According to international humanitarian law, it is the duty of the sides engaged in a conflict to locate, gather, and recover the bodies of the deceased.

US Demand and Local Recovery Operations

On Saturday, the US president issued a two-day ultimatum to the militant group. “They is going to have to begin returning the remains of the hostages who died, including American citizens, quickly, or the additional nations participating in this significant truce will take action,” he posted on his online channel.

As the 48-hour deadline approached, Hamas, joined by the Red Cross, joined Egyptian teams, who were authorised by Israel to look for remains past the boundary marking the withdrawal of troops inside Gaza. An Israeli spokesperson said the Egyptian team would use excavator machines and vehicles in the operation.

Official Verification and Media Coverage

This development was supported by an source within Israel, who told Hebrew-language media that members of the group had been allowed to access sections of the region under Israel Defense Forces (IDF) control to search for the bodies of captives, alongside Egyptian and ICRC teams.

Footage published by a media outlet seemed to show members of a Hamas unit – part of the group’s military wing tasked with holding captives – accompanying a humanitarian transport in a specific location close to Rafah, which lies outside IDF jurisdiction.

Challenges in Locating Captive Remains

Efforts to locate for the remains of individuals taken captive has turned into one of the most delicate matters in the ceasefire reached between the parties. However, the attempt to locate the bodies has been challenging from the outset, given the existence of an estimated enormous amount of rubble across the territory, where, as per health officials, at least 10,000 Palestinians are listed as unaccounted for, buried under the debris.

Conflicting Claims on Body Location

The group has stated it does not know the precise whereabouts of all the bodies, saying it has lost contact with a number of its teams that had been detaining the hostages and were allegedly eliminated during military strikes.

In contrast, an Israeli government spokesperson claimed that the organization was aware of the locations of the remains. “Should the group exerted greater effort, they would be able to recover the bodies of our hostages,” the official said.

US Stance and Weapons Surrender Talks

Although the American leader has acknowledged that some of the remains are difficult to access, he said that “the rest they can hand over immediately and, for unknown reasons, they are not.”

“This could be related to the surrender of weapons of the group,” he noted.

The US administration has said it has obtained guarantees from Hamas that the group will disarm, though no specific schedule has been set. The militant organisation remains reluctant to give up its arms without solid assurances about the fate of its fighters.
